Where is the Justice?
August 13, 2008
If you missed Wednesday’s show then no doubt you haven’t heard about the miscarriage of justice in a Maricopa County court room because most news outlets let this one slip by without comment. On Tuesday, Judge Tim Ryan screwed us all when he let a child killer off with probation. Not to single him out alone, please be assured, CPS and lawyers were adequately involved too. Sure there’s more to the story—the killer is the two year old girl’s mother—I mean, walking womb—who starved her baby to death. Somehow she forgot to feed her child but was able to remember to take out a nice little life insurance policy only a week before little Nakeisha perished. Apparently, that didn’t seem to matter to the good judge. He liked probation.
But why? Perhaps it’s because the little girl’s brain was damaged–possibly from the drugs mamma took while the baby kicked inside her. So the argument could be that it was only humane to kill the kid because she was “different” and had too many special needs. CPS visited the family 5 times but to no avail. Judge Ryan heard the excruciating details but wasn’t moved and mom—well mom gets to go home to her other two kids because they are normal and less trouble.

D,
After listening to your show this morning and hearing the horrific details of this monster’ (walking womb is too kind) killing her baby and the unbelievable action (or non action) the courts took has caused me to spend a good portion of the day and now evening trying to figure out how this could happen.
The only conclusion I can think of is.. who benefits from the judges ruling?
1. The monster and her attorney
2. CPS-If she had been charged with murder or even aggravated abuse of a child- CPS would have to answer on why they were there 5 times and still allowed this crime to happen. Since there is only an attempted abuse charge and not a major felony, it now is looked at as an unfortunate incident with no one to shoulder the blame.
It would be interested to see Judge Ryan’s docket for the past couple of years and see if the rulings where CPS was involved are consistent with the hand slap he administered to the monster.
Maybe the insurance company that the monster filed the policy with will step up and at least charge her with fraud. I mean how clear cut of a case do you need?
Although it may have been difficult for the monster to put down her crack pipe and give her daughter the extra attention she required, the fact remains that with proper care her daughter would be turning 5 this year and instead she’s gone. Very, Very, Very Sad.
First of all great show Ankarlo!! the state of Arizona and American citizens need a voice with power and the media provides this. You do a great job asking the tough questions and confronting corruption…
This story brings tears to my eyes as I type, I don’t know what to really say and when I hear of stories like this it really affects my fragile faith I currently have.. I have been through allot in my short life (33 yrs old) but I cant even imagine what that poor innocent child went through (sigh) I wish I would have been the case worker or investigator I WOULD HAVE REMOVED THE GIRL AFTER THE 1ST VISIT!!
Well keep on doing what you are doing man. If I am ever elected for congress or a position of power, you can have as many interviews as you would like…. I think Obama will bring some good change to this country, but not enough and not like I would if I was President!!!
Also, I think you’re right about the CPS and Judge Ryan connection/partnership. There is some corruption there definitely and well it is just like the entire American government. Allot of it is built and supported buy corruption, how sad it is how sad indeed…
Well thanks for your time and consideration
best of luck to you now and in the future
Sincerely,
Shawn Pannell
Where was Andrew Thomas and his office?
Probably out doing more book signings. You are partly to blame for this Ankarlo. This is what happens when you allow public officials to spend more time campaigning with public money than doing their jobs.
Ankarlo,
Today, 8-14, at about 10:25am you had a sex crime advocate named Tony call into your show. I would like to hear more from him regarding the outlandish penalties being handed out to people who really need help, not prison time. They are sending young men and women away for years without possiblilty of parole for crimes far less than murder, armed robbery etc. See if you can get him to call back I would love to talk to him………..
Thanks for your comments, color and show..
yeah i’ll be glad to speak my mind! justice was definitley not served. every person involved in this case; including the so-called “judge” should not only be starved for 2yrs. and if they survive, should be tied to a public rack where they can be told daily how they have brain damage and this is why they are being starved to death. this is a despicable act of “so called justice” and this story should have gone to every news paper and t.v. program out there so that people can know this story and the proper justice would have been done. this story should teach us all a lesson; that we are to protect the children no matter what because if we don’t we all are guilty of the crime, and lose are own compassion and humanity in the long run. yes, i have something to say!
ARE YOU KIDDING?!!!
If this woman is capable of watching her child starve and subject her other two children to watching their sibling starve, she has no business walking around free and no business raising the other two. The other two children have already been damaged by the lack of compassion in the home! This mother is a menace to society. Her thinking process is defective. What happens when the other two children get sick or have a catastrophic injury? (God Forbid) Will she get rid of them too? The judge also has a problem, he was not thinking clearly. This woman needed to go to jail for a very long time! The judge needs to do community service, either in the Humane Society or a home for disabled children. If that dosn’t change his thinking then I suggest he gets another job.
i cant believe this garbage only got probation after killing her own child, its very sad that this garbage is walking the streets of phoenix, how could she kill her child?unbelievable.but one day she will pay for everything she has done on earth.and about the judge who gave her probation, she probably gave him the same drugs she uses.
Oh Great Oz Ankarlo, ratch it up! ratch it up! We know where this is going! It’s all about “abortion” Even if you are in a vegetated state, this is a no brainer! Oh we got one of those judges that judges from the bench and not from the “PULPIT” Maybe all of that is in play! ratch it up! ratch it up!
It’s amazing how you use women; on one hand they are all like Hillary Clinton, “why did she stay? Then on the other side of the coin you use their parenting emotion to justify your show against! Against women, pro choice, or the mere fact that a woman has a choice! I find it amazing how women play right into that mold. At home, being the great moms that they are, listening to your constant pitch. All of sudden “clinging” to the radio as though you are speaking on their behalf and their plight in life. OMG, OMG “If i had a choice” well i meant to say “if I didn’t have a choice” because the judge did, and she did. I would take it away, take it away today, and this day only!
Go ahead, ratch it up, because this Judge is not the kind of judge that looks at “enforcement” as the ways and means of solving our Immigration woes in America or your valley. He ain’t on board with “enforcement” Comrads, “enforcement only. He has “reform” flowing through his American “soiled” blood He is a Pro Choice when it comes to Immigration Reform. Go ahead ratch it up, for those women who are codependent on the pain of another. Codependent in helping others, as satisfaction for being the human being that they are! Mothers, Motherly and gifted with life and all the decision in life!
We already know where this is going to lead! Obama a man, and his view on a woman and her view and right towards her rights as a woman. We can’t have no stinkin Judges giving “rights to women” especially those privacy rights! We can’t have no President who is pro this or pro that, what would Rev Ted Haggert say after his Oxycontin Drink at 7. What would Rev Hagee say, while counting last weeks 10% plus 5% tides towards a more Fair and Unbalanced Media.
Extreme Conservatives don’t look at History, they don’t look at the Constitution. We get it already.
Well happy DUI Check “ENFORCEMENT” no fun in Arizona Weekend to you too. I’m getting that tan everyone “profiles” while walking by. I think I’m starting to look like a “ROCK STAR” anyone seen Britney or Paris in the Great AZ?
John McCain can’t control “evolution” but we see he can control a woman! Go ahead, there is your start and finish! Ratch it up by way of the death of child.
On appeal by the State, it should be murder, or voluntary manslaughter if she wasn’t suffering from any psychological problems, obviously so!
This in in response to Roger;
What is Ankarlo ‘ratching up’ in your oh so great opinion? Ratching up the fact that a mother who starved her child to death got only lifetime probation? People busted with an ounce of marijuana will see more jail time then this woman.
On the vegitative state comment, who are WE to decide whose life is more valuable? So, because this little girl had special needs - due to her mother’s drug use while pregnant - she has a lower life quality then a healthy child with no issues? It’s not up to us to decide who has a more valuable life, but abortion has made it easier for people to continue to devalue human life.
The ‘punishment’ of this woman is sickening and most certainly does not fit the crime of murder. Of course, that’s my opinion, and the last time I checked I’m still entitled to have one of those.
Is this guy roger morris kidding? I heard you this morning (friday) talking with”paul” and it is disgusting that this woman got off and we treat animal abusers worse than child killers. There is something seriously wrong with our system (legal and cps). When will cps be held accountable for their lackluster job? They have childrens lives in their hands and they do nothing…I know they can be overworked but they don’t follow up when a child is in danger and that’s just wrong.
Ronnie, people spend more time in jail for marijuana because they don’t know or understand the law relating to it. Marijuana is illegal, but under another great Prop 300, most people cop to a felon or this mystical “usable amount” theory played by the courts and the state. That is why they spend more time in jail than this person may or will. They aren’t crazy, but when they stand up in court and say, a yes your honor, it was a usable amount per the State of ARizona. Duh! all of sudden two wrongs don’t make a right, and that hard head, now becomes a hard wallet.
If the county attorney wasn’t spending more time presenting a case against a licensed escort ring, that “ADVERTISES IN NEW TIMES” than spending the time to present the case in demonstrous way to lock this person up for the rest of her life. The judge followed their order, and the presentation and defense dissent towards the prosecutions case. That is why she got probation, they offered it to her upfront basically, leaving it up to the judge to decipher their stupidity.
What I meant by “ratching” it up, because Obama and McCain were going to be speaking at the pulpit, and Ankarlo, was going to set him up as though he is a “AFTER YOU ARE BORN” BABY KILLER. It was about Abortion to him in my little crystal ball. He used this story to portray a judge, as this “OUT-0F-STEP” Obamanation to the courts.
I meant by “ratching” it up as though the judge who possibly allowed a immigrant go back home or something, and that he isn’t following the “strict out-of-step extremisim” expressed by our County Attorney and his “personal” Sheriff.
And no I wasn’t kidding, Ankarlo, the Lobbyist for the right all of sudden, is counting his eggs before they hatch. Glenn Beck is coming to town like the Marxist Santa Clause that he is with all his White Theology and that he has talk to the “Holly Spirit” and was told Obama is the Antichrist. At least until John McCain is elected and his “EMBROYNIC” Stem Cell Vice President will arise from the petrie dish and will us all his so ever lasting servants.
Why blame the judge or the girl, she is obviously sick and has a pattern for her illness, the County Attorney let you down, and the Great Oz Ankarlo, and Mac Moses Watson with their “staffs” were attempting to part the sea for some more RICO Monies. Can you believe that Roger Morris, no can you believe the “Audacity of Hope” they have attempting to portray people as they wish.
God wants World Cup not False Prophets! Beck and his fab five freddies, Ankarlo, (whom I’m losing respect for daily) Watson, Hannity, Limbaugh and his 14 year old male date of the day, and the big Pink Taco O’reilly. It’s depressing at times to think people honestly are so misdriven out there that reality is no longer reality, just this mystified before and after dinner; suspension of disbelief, paraphrased and unclear!
So it’s not the judges fault and you don’t have to elect John McCain because Saturday night at the pulpit he said he would put nothing but “REPUBLICANS” OF THE STRICTEST OUT-OF-STEP CONSERVATIVE VIEWS Possible. This Judge didn’t ask John McCain to make him a U.S. Attorney, unlike Andrew Thomas.
Why not talk about Rick Renzi’s case that didn’t land him in jail forever. What about Rick Renzi, where is Beck and the fab five freddies on that “BREATHTAKING ABUSE OF THE JUDICIAL SYSTEM” What about that Judge who postponed something so BREATHTAKING and directly against you!
Trying to understand why a judge assigns certain sentences can be frustrating but taking a closer look at the purpose of conviction sentencing can help to alleviate some of the confusion.
Our Justice System–though imperfect–has always been based on fairness and forgiveness; as the adage goes: let the punishment fit the crime. This does not necessarily imply “eye for an eye,” however as the true purpose of the system is to first of all punish offfenders who jeopardize the safety of the upstanding citizens, but moreso to protect the inherent freedoms promised in the Constitution. Although abuse of this power can (and does) occur, and although flaws do currently exist, I still believe that when we allow our elected court officials to dole it out, we are exhibiting as a people–and a community–the essence of our freedoms. However this is slightly beside the point.
The second and most important aspect of the judicial system is to rehabilitate and re-educate offenders so as to prevent ffurther abuses or violations of our existing laws. This is where I believe the argument against the sentencing for the “monster” (as so many of you insist on calling her). It is easy for the public to feed on our emotions (as the mob of the Roman coliseum calling for blood), allowing our primal instincts to control our reactions, and accordingly proclaim death on an ill-to-do-mother who neglectfully causes the death of her children (by choosing substance abuse over responsibility), but a superior court judge has the ability and therefore the responsibility to act upon their understanding of and experience with the judiciary processes, seperating themselves from their emotions and making decisions based on facts and a cognitive thinking. In this case Judge Ryan chose to place the plaintiff on probation instead of sentencing her to prison. Again, this is a decision that would justly infuriate any compassionate human being, but a closer, RATIONAL observation of the long term effects of probation versus incarceration might yield a more forgiving attitude. Immediately condemning this woman into a jail cell only prevents her from potentially harming other children for the duration of her sentence. At the end of five or seven or ten years (or perhaps sooner with parole hearings) she will return home and her potential to “re-offend” will have increased because she was not properly rehabilitated. Because she is a substance abuser, her potential to use again will also increase, and this is because it is often difficult for an ex-convict to readjust to everyday society; to communicate effectively their feelings and thoughts, and most importantly generate an income and maintain a job that will allow her to regain self-respect and the respect of those around her. Studies also show that many convicts have trouble finding and keeping a job, which leads to not only drastic actions that can result in subsequent convictions, but can cause a relapse in whatever abuse treatment or recovery they may have experienced.
Probation, conversely, allows an offender to undergo constant court-mandated improvement programs while learning how to implement newly learned skills in the world. It offers support groups and most of all the potential for public forgiveness and eventually personal forgiveness; because in the end the only person whose forgiveness she will truly desire is her own.
Keeping her out of jail and in rehabilitation programs or out-patient support groups/counseling, also places the responsibility of paying the cost of her restitution on herself (as opposed to the employed tax-payers whose freedom pays for the jails that they themselves never use…).
Court-monitoring will provide the opportunity for her to work through her vices and hopefully eventually overcome whatever demons she may be deflecting through chemical dependency. It will create a controlled environment for her to serve her sentence while improving her situation. The best aspect of lifetime probation, however is that if she fails to fulfill any of her court obligations, Judge Ryan can issue her a far greater punishment.
ROGER-
speaking of the”audacity of hope”, one could only hope that the mother of that poor child that was starved to death could have only been your mother, being that you are completely out of your mind.Your obvious hate for anyone else’s opinion other than your own is obvious, and now bringing”white theology” into the mix. Wow.. you are a real winner. This case is not about race, it is about a child dying a most cruel death at the hands of her mother,ON PURPOSE(life insurance policy) and no one stepping in. CPS should be punished, the mother should go to jail, and the judge should be removed from the bench. This is definately a miscarriage of justice!!
